Canon Gallery Terms and Conditions
We will update these Terms and Conditions from time to time. We will keep you updated on any changes to these Terms and Conditions by publishing them online. We will also use any of the communication methods provided by you to inform you of significant changes to these Terms and Conditions, if any. If you continue using the Canon Gallery after we have published updates to these Terms and Conditions, you agree to be bound by the updated terms.
1. What is Canon Gallery?
The Canon Gallery and Canon Showcase are websites which are operated by Canon and that are dedicated to the display of user generated content (or UGC). By creating an account through the registration process, you will have the option of uploading and submitting your digital content, such as photographs and/or images (“Content”), to Canon for public display on the Canon Gallery. Canon may display your Content on the Canon Gallery if your Content satisfies these Terms and Conditions and is otherwise appropriate for public display.
On creating an account, you are issued with a Canon iD. This Canon iD will be required every time you upload and submit any Content for display on the Canon Gallery. The Canon iD you hold or receive may also be used to access other Canon services offered online. The remaining Terms and Conditions on this page relate to the Canon Gallery and your use of it and are in addition to the full Terms and Conditions concerning your Canon iD.
2. Who can use Canon Gallery?
Once you have created an account, you may submit Content for public display on the Canon Gallery if you are located in Europe, Middle East and Africa and are aged 18 or over. Anyone can access and view the Canon Gallery. However only an account holder can upload and submit Content to the Canon Gallery. An account holder who is aged under 18 years is only permitted with the express permission of a parent or legal guardian to register and/or create an account and submit Content.
3. Use of your Content
You confirm that your Content is your own original work, is not defamatory or unlawful and does not infringe anyone else's rights (including privacy rights).
You maintain copyright in all Content you submit but you consent to Canon displaying your Content in the Canon Gallery, Canon Showcase, on Canon’s Social Media platforms (http://www.canon-europe.com/about_us/social-networks/) and Canon websites within EMEA (“Sites”) free of charge and in perpetuity.
Canon will credit you, the account holder, as the author of the Content you submit if it displays the Content on the Sites. If you are not the author of the Content you submit, you should ensure you have consent from the author to submit the Content under your own name and to be identified and attributed as the author.
4. How may Canon use your Content
Canon reserves the right in is sole and absolute discretion to decide whether or not to display any Content you submit.
All Content submitted will be moderated by Canon, or its appointed agent, to ensure that the Content is appropriate for display on the Sites. Canon may decide not to display certain Content which you submit for a number of reasons so please do not be offended or upset if Canon decides not to display your Content.
So that certain Content may be displayed on the Sites, it may be necessary for Canon to crop, reduce the size of or otherwise modify your Content for display purposes on the Sites. In submitting your Content you agree to Canon modifying your Content where Canon deems it appropriate.
5. Canon reserves the right to contact you
Canon may wish to contact you about your Content, for example, if Canon wishes to feature your Content in the Canon Showcase. Accordingly you hereby agree to Canon or its appointed agent contacting you through the contact address provided when you create your account.
6. Third party rights
You should ensure that you have consent from all third party rights holders in your Content before submitting it for public display on the Sites.
A rights holder may be a third party brand or company name, a person shown in the image or a famous building. You should satisfy yourself that you have all the rights and consents necessary before you submit your Content for display. In submitting the Content Canon will take it at “FACE VALUE” that you have all necessary rights and that you have obtained consent from any people or brands shown in any Content. Canon cannot accept any responsibility and/or liability for infringement of third party rights by the display of your Content on the Sites brought about by your submission of the Content and will direct any third party claim to you.
7. Your responsibility
You are responsible for the Content you submit.
Should any Content you submit contain illegal material, Canon reserves the right to pass the Content and your contact details to the appropriate law enforcement authorities for investigation. Accordingly you hereby agree to Canon disclosing your contact details to appropriate law enforcement authorities in the event you submit illegal Content.

9. Disclaimer
Canon hereby excludes, to the maximum extent permitted by law, all conditions, warranties, representations or other terms concerning the supply or purported supply of, failure to supply or delay in supplying any service in connection with the Canon Gallery or Canon Showcase, or any e-mail communication in relation to the Canon Gallery or any service provided is accurate, complete or up-to-date, which might but for this Section 9 have effect between Canon and you, or would otherwise be implied into or incorporated into these Terms and Conditions or any collateral contract, whether by statute, common law or otherwise. You understand and agree that you are using the Canon Gallery at your sole risk and that Canon does not warrant that the Canon Gallery or any e-mail communication in relation to it, or any service provided will meet your requirements or that the Canon Gallery will be uninterrupted or error free. Any content or services provided via or in connection with the Canon Gallery by Canon is done so on an "AS IS" and on an "AS AVAILABLE" basis and Canon makes no representations or endorsement of any kind, whether express or implied, with respect to the Canon Gallery for the content or services included in, or made available in connection with, the Canon Gallery. Canon reserves the right at its sole discretion, to amend or withdraw any content or services offered as part of the Canon Gallery.
10. Liability
Canon and any of Canon's group companies and the officers, directors, employees, shareholders or agents of any of them, exclude, to the maximum extent permitted by law, all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party, (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages) arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise in connection with the Canon Gallery in any way or in connection with the use, inability to use or the results of use of the Canon Gallery, any e-mail communication in relation to the Canon Gallery or any service provided, any websites linked to the Canon Gallery or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Canon Gallery or your downloading of any material from the Canon Gallery or any websites linked to the Canon Gallery. This shall not affect your statutory rights.
11. Canon’s Trade Mark
No one is permitted to display or use in any manner the Canon or Canon group trade marks or logos without Canon’s prior written permission.
12. Choice of Law and Forum
These Terms and Conditions and any dispute relating to it shall be governed by the law of England and Wales, and disputes relating to these Terms and Conditions shall be resolved in the courts of England and Wales.
As a user, you may be entitled to bringing court proceedings in your own language and in your local courts. A local consumer advice organisation will be able to advise you of your rights. These terms and Conditions do not restrict your statutory rights.
